GENERAL
1. Applicable local, state, and federal laws and regulations will govern all flights.
2. Students will report to their instructor at the airport for all
scheduled periods. If weather is questionable, call for instructions.
3. Permission to be absent from a scheduled period without penalty must be secured in advance from your instructor.
SAFETY
1. SAFETY is the key to being a GOOD PILOT.
2. Do not smoke in the hangar, in the vicinity of any aircraft, near the gas pumps and fuel trucks, or AT ANY TIME while in the aircraft.
3. When on the aircraft ramp, remain well clear of all running and taxiing aircraft.
4. Treat all aircraft as though the ignition switches were “ON” at all times.
5. Be thorough in conducting your preflight inspection. NEVER ASSUME THAT AN AIRCRAFT IS AIRWORTHY BECAUSE IT HAS JUST RETURNED FROM A FLIGHT.
6. If your preflight inspection reveals a questionable or unusual condition, report this to your instructor immediately.
7. Never leave the cockpit of the airplane with the engine running.
8. When starting the engine, call “CLEAR” prior to and at the time of start.
9. All aircraft will be tied down in the designated areas and secured with tie-down fasteners.
10. Notify the instructor of any maintenance discrepancy immediately after securing the aircraft and fill out the maintenance discrepancy from on the aircraft.
DISPATCH PROCEDURES
1. No student will begin a solo flight unless signed off by an authorized flight instructor.
2. All flights will be assigned and dispatched in agreement with the appropriate lesson of the flight-training syllabus by an instructor.
3. All flights will be conducted in accordance with FAA regulations.
4. Remain within the boundaries of the practice area at all times, except when on assigned cross-country training flights.
5. When in doubt of weather, or changing weather conditions appear marginal, return to the airport and land immediately.
6. Standard traffic patterns will be flown at all times unless a deviation is specifically authorized.
7. No simulated emergency landings will be practiced solo. During dual instruction, no practice emergency landing final approach will be continued below 500 feet AGL if not in the airport traffic pattern.
8. If landing cannot be made in the first one-third (1/3) of the runway, GO AROUND.
9. Student solo night flights are not permitted.
STARTING PROCEDURES
1. A flight instructor will be in the airplane for all pre-solo student engine starting.
2. A fire extinguisher will be available for all engine starts and is strategically located in the aircraft.
3. Hand propping is not permitted.
TAXI PROCEDURES
1. Taxiing around other aircraft will be extremely slow.
2. Taxiing on taxiways will be no faster than a fast walk.
3. Do not taxi with the brakes on.
4. Do not try to maneuver through a tight area without an outside observer watching the wing tips.
5. Observe correct position of controls with respect to wind.
FIRE PRECAUTIONS AND PROCEDURES
1. Extreme care should be taken to avoid over-priming in cold weather.
2. Should a fire start, shut off the engine with mixture control to IDLE CUTOFF, KEEP CRANKING
the engine to suck flames and accumulated fuel through the carburetor,
TURN MASTER OFF and EVACUATE airplane, get fire extinguisher.
EXTINGUISH FIRE.
3. If not at home base airport, call instructor at home or at airport for further instructions.

RE-DISPATCH PROCEDURES
1. Should a landing be made at a non-planned airport, the student should call instructor David Griffith at (678) 936 - 8246.
2. Failing to make contact with any of the above will mean staying overnight and calling instructor at 0800 the next morning.
3. On overnight, secure airplane with tie-downs, install control lock, make certain MASTER switch is turned off, and lock airplane.
REPORTING AIRCRAFT DISCREPANCIES
1. Note ANY discrepancy during flight.
2. Write down any discrepancy on the SIGN-IN SHEET (Hobbs / Tach time record).
3. No flight will be made without checking SIGN-IN SHEET for discrepancies to ensure aircraft airworthiness.
4. Only flight instructors and mechanics are authorized to ground aircraft.
SECURING AIRCRAFT
1. Park the airplane at the specified tie-down and secure.
2. Install control lock.
3. Turn MASTER OFF.
FUEL RESERVE
Local Flights:
a. No flight will be made unless, at the start of the flight,
the aircraft has at least one-half (1/2) full fuel, checked visually.
b. Plan on landing when gauges show one-fourth (1/4) full.
Cross-country:
a. Flight will begin with full fuel, checked visually.
b. Flight Plan having at least 60 minutes of fuel upon landing.
COLLISION AVOIDANCE
At all times while occupying a pilot’s seat, you will maintain surveillance of
other aircraft on the ground or in flight.
OTHER RULES
1. Spins will only be practiced when an instructor is on board. Aerobatic maneuvers are strictly forbidden.
2. Stalls will be done so that the lowest altitude in the maneuver is at least 1500’ AGL and not over a congested area or an airway.
3. No student pilot may start a solo practice flight until an instructor approves the flight.
4. ALWAYS PRE-FLIGHT THE AIRCRAFT.
5. Completely remove any ice and frost from the windshield and aircraft surfaces.
6. USE THE CHECKLIST EACH AND EVERY TIME YOU FLY.
7. Know the fuel system, capacity, and consumption of your aircraft.
8. Know and comply with FAA air traffic rules.
9. If you cannot meet your schedule, always call ahead… even if the weather is bad.
10. A pre-takeoff and pre-landing checklist and pilot’s operating handbook must be on board for flight instruction and solo flight.
AIRPLANE CONDITION
Student pilot will inspect and
make a ground check of
the Airplane and accessories before takeoff and occupying Airplane until
he/she is satisfied as to its airworthiness and proper functioning of the
Airplane and accessories. The corporation makes no warranty, or representation,
either expressed or implied, regarding the fitness, quality, design, material,
condition, capacity, suitability, or performance of the airplane. The
corporation shall not be liable for any defect in the Airplane.
ASSUMPTION OF RISK Student pilot assumes all risks while occupying
the airplane for himself / herself and on behalf
of all persons including but not limited to third parties, in, on, and around
the Airplane, and agrees to indemnify, defend, and hold all shareholders,
the corporation, the corporate officers and all their agents, officers,
employees, successors, assigns, David M. Griffith, the city of Gainesville, and anyone associated
with Hall county, the airport authority, Lee Gilmer Memorial Airport or any employee of Lee Gilmer Memorial Airport,
harmless for any and all injury,
loss, or damage to shareholder, student or renter pilot, or to any and all persons in, on and around the
Airplane, or any third party injured or damaged through the operation of the
Airplane.
DAMAGES
Student, shareholder, is responsible for any and all damages which they would be
legally liable for through their negligence of operation.
ADDITIONAL INSURANCE It is recommended that "Non-Owned Aircraft Liability and
Aircraft Damage Liability" insurance be
obtained by student and shareholder pilots. Insurance may be obtained by contacting
Barbara Doss at CS & A Aviation Insurance, Cumming, GA (678) 513 - 6262 or toll-free at
1-800-761-2557.
CANCELLATION OF AGREEMENT
This agreement may be cancelled by either party at any time with written notice.
At time of cancellation, any monies due by the individual (share holder, student
pilot) to the corporation are to be paid upon request. This agreement is
canceled automatically, and share ownership reverts back to corporation automatically, with no written notice required, when shareholder
fails to pay two consecutive monthly
dues payments.
NOTICES All notices, requests, demands or other communications under this Shareholder Agreement
shall be in writing and be personally delivered against a written receipt, delivered
to a reputable express messenger service (such as Federal Express, UPS, etc.)
for overnight delivery, or transmitted by mail, registered, express or certified, return
receipt requested, postage prepaid at the address last recorded at the corporation's
office. Individuals may change their respective addresses for notices by giving
notice thereof to the corporation. All notices, demands and requests shall be
effective and shall be deemed given upon being personally delivered against a written
receipt, upon being properly delivered to an express messenger service or upon
being deposited in the United States mail in a manner listed above in this paragraph.
The time period in which a response to any such notice, demand or request
shall commence to run, however, shall begin on a date of such personal delivery,
date of delivery by the express messenger service or the date shown on the
return receipt, as applicable; provided, however, that if the recipient of such notice
refuses acceptance thereof, then the time period in which a response to such
notice must be given shall commence to run two (2) days following
such mailing.
ASSIGNMENT
Share cannot be sold, assigned, traded or exchanged without prior written consent from corporation.
ARBITRATION
Shareholders waive all rights to legal proceedings regarding disputes, grievances, or claims of any nature with
the corporation, the corporate officers and all their agents, employees, successors, assigns,
David M. Griffith, and/or with any co-partner, and agree to participate in binding ARBITRATION before
a professional arbitrator that is a member of and abides by the rules and guidelines of the AMERICAN
ARBITRATION ASSOCIATION. The corporation reserves the right to seek civil
or criminal remedies available against any shareholder if their actions directly or indirectly cause
damage or loss of value to the aircraft, equipment, income or property.
APPLICABLE LAW
This Shareholder Agreement shall be governed by and construed in accordance with the
laws of the State of
Georgia.
SCHEDULING OF AIRCRAFT
Aircraft are scheduled on a first-come, first-serve basis, however as this
corporation is set up to provide training for those continuing their flight
education, preference
will
be given to any aircraft scheduled for continuance of training towards any
license or certificate. Aircraft shall not be scheduled for more than six
consecutive hours without prior permission. In the event of a dispute
concerning scheduling,
Dave Griffith will have final authority.
PROOF OF CITIZENSHIP REQUIRED per T.S.A.
U.S. Citizens: Determine Applicability. The requirements for determining citizenship status
for any student, whether U.S. or alien, applies only to flight training toward
a recreational pilot, sport pilot, private pilot, instrument rating or
multiengine rating. Evidence of U.S. citizenship must be shown by one of the following:
(1) Valid, unexpired U.S. passport,
(2) Original birth certificate of the United States and a government-issued
picture ID.
Required endorsement:
"I certify that [insert student's name] has presented me a
[insert type of document presented, such as a U.S. birth certificate or
U.S. passport] establishing that he / she is a U.S. citizen or national in
accordance with 49 CFR 1552.3(h). [Insert date and instructor's signature
and CFI number.]"
REFUNDS / LIMIT OF REIMBURSEMENT
No refunds on monthly dues, aircraft-use fees or instructor fees.
SHARE BUY BACK
In any event that share buy back is necessary, Shareholder agrees to sell share back to corporation for $1.00 (one dollar).
FUEL
Aircraft-use rates for aircraft are "dry rates". Student pilot is responsible for topping off aircraft with fuel
after each flight and is responsible for paying for fuel. An account on the field should be set up.
PRICES
Initial share: $275
Monthly dues: $35 per month
Aircraft-use: $59.00 / hr. dry
Instructor: $41.00 / hr.
ENTIRE AGREEMENT
This document constitutes the entire agreement between the shareholder and the corporation, and no promises or representations, other
than those contained here have been made by the corporation. By signing below, Shareholder is indicating he/she has read this document,
agrees with and understands the covenants and obligations listed, and enters into this agreement of his/her free will with Capital Investment Group,
Incorporated, whose C.E.O. is David M. Griffith. Any modifications to this agreement must be
in writing signed by corporation C.E.O. and Partner. This is a binding legal document. If you do not understand anything
contained in the SHAREHOLDER AGREEMENT, do not sign it.
